Is Cannabis Legal in Belgium?

Recreational cannabis is illegal in Belgium. Since 2003, possession of up to 3 grams by adults for personal use has been handled administratively rather than criminally — but it is not legalised. Medical cannabis is limited to two licensed pharmaceutical products available on prescription.

Belgium takes a nuanced approach to cannabis that is often misunderstood. Recreational cannabis is illegal under the 1921 Drugs Law. However, since 2003, adults aged 18 and over caught with up to 3 grams for personal use face an administrative fine rather than criminal prosecution — provided there are no aggravating circumstances. This is decriminalisation, not legalisation.
