Is Cannabis Legal in Benidorm?
Cannabis is not legal in Benidorm. Under Spanish national law, private personal use is decriminalised but public possession carries administrative fines of €601 to €30,000. Tourists cannot legally buy cannabis anywhere in Spain, including Benidorm.
Benidorm follows Spanish national cannabis law, which takes a distinctive approach: cannabis is illegal, but private personal use and cultivation at home are decriminalised. This means using cannabis in a private space will not result in criminal prosecution, but it does not mean cannabis is legal to buy, carry in public or use outdoors. Public possession or consumption — including on Benidorm's beaches, streets, parks and hotel balconies — is an administrative offence carrying fines from €601 to €30,000 under the Public Security Law (Ley Mordaza). Tourists also face the fundamental problem that there is no legal way to purchase cannabis in Spain. Buying cannabis requires an illegal transaction regardless of where the subsequent use takes place.
Spain's Cannabis Law Framework — What Applies in Benidorm
Benidorm is a resort town in the Valencian Community on Spain's Costa Blanca, and its cannabis laws are those of Spain nationally — there are no local Benidorm-specific rules that differ from the rest of the country. Spain's approach is governed primarily by the Organic Law 1/1992 on Protection of Public Security and the Penal Code. The key distinction in Spanish law is between private space (tolerated for personal use) and public space (prohibited and fined).
Spain has never legalised cannabis. The decriminalisation of private use is not a legal permission to use cannabis — it is simply a policy of not criminally prosecuting personal use at home. The supply chain that would lead to that private use remains entirely illegal.
What Is and Is Not Allowed
Private personal use
Decriminalised — not legalConsuming cannabis in a genuinely private space (your own home, a private residence you are staying in) will not result in criminal prosecution under Spanish law. This decriminalisation has developed through case law. It does not apply to hotel rooms, holiday apartment communal areas or any space with public access. Purchasing the cannabis for that private use is still an illegal transaction.
Home cultivation for personal use
Decriminalised in private — not legalGrowing cannabis plants at home for personal use, not visible from any public area, is treated similarly to private use under Spanish case law and is generally not criminally prosecuted. The plants cannot be visible from a street, neighbouring property or any public viewpoint. This exemption applies to Spanish residents with a home — not to tourists staying in holiday accommodation.
Public possession and consumption
Administrative offence — serious finePossessing cannabis in any public space — beaches, streets, promenades, parks, hotel lobbies, restaurant terraces — is an administrative offence under the Public Security Law. Fines range from €601 for minor possession up to €30,000 for more significant quantities or aggravating circumstances. Police confiscate the cannabis. This applies to tourists and residents equally. Benidorm's tourist-heavy seafront and beach areas are regularly policed.
Purchasing cannabis
Illegal — no legal purchase route for touristsThere is no legal retail cannabis market in Spain. Purchasing cannabis from any person or establishment is an illegal transaction. Tourists in Benidorm have no lawful route to obtain cannabis. Street dealers operate illegally and purchasing from them constitutes a criminal act on the buyer's part as well as the seller's. Many tourist-area dealers also operate scams targeting foreign visitors.
Cannabis social clubs
Legal grey area — not open to touristsCannabis social clubs exist across Spain, operating as private non-profit membership associations where members collectively cultivate and consume cannabis. Clubs require Spanish residency and pre-registration — tourists cannot simply walk in. Even registered clubs operate in a legal grey area that varies by region and judicial interpretation. Benidorm has fewer clubs than Barcelona or Madrid due to the predominantly tourist-focused nature of the town.
Supply, trafficking and large quantities
Criminal offence — prison sentenceSupply, trafficking and possession of quantities beyond personal use are criminal offences under the Spanish Penal Code. Prison sentences of one to three years apply for minor trafficking offences, rising to six or more years for large-scale operations. Being found with quantities that suggest intent to supply rather than personal use carries significantly harsher consequences than simple possession.
Administrative fine for public cannabis possession in Spain under the Public Security Law — no criminal record but significant financial penalty
There is no legal way for tourists to buy cannabis anywhere in Spain — purchasing requires an illegal transaction regardless of intended use
Spain's tolerance applies only to genuinely private spaces — beaches, streets, hotel balconies and public areas are all subject to fines
Practical Advice for UK Tourists in Benidorm
Benidorm attracts several million UK tourists each year and is heavily policed in the resort areas. The laid-back holiday atmosphere can give a false impression of tolerance, but Spanish police enforce the Public Security Law actively. UK visitors should be aware of several specific practical points.
- Hotel rooms and holiday apartments are not considered genuinely private spaces in the way that a personal home is — using cannabis in hotel accommodation or on a balcony visible to others carries risk.
- Benidorm's beaches and promenade are public spaces where possession and use are fined — the beach does not constitute a private space regardless of how far from other people you sit.
- Bringing cannabis into Spain from the UK is a customs and criminal offence regardless of the quantity — Spain's private use tolerance does not apply to importation.
- Medical cannabis prescribed in the UK cannot legally be brought into Spain. There is no formal reciprocal medical cannabis framework between the UK and Spain.
- A UK medical cannabis prescription provides no legal protection in Spain and Spanish police will not accept it as a defence for possession.
Spain's relaxed reputation around cannabis sometimes leads UK tourists to assume Benidorm operates similarly to a Dutch coffeeshop destination. It does not. The Netherlands has a specific coffeeshop licensing system that creates a limited legal retail framework. Spain has no equivalent. The Spanish private use tolerance is meaningful only for people with access to a private home and a legal growing setup — neither of which applies to a tourist on a package holiday in Benidorm.

Frequently Asked Questions
Can I smoke weed on the beach in Benidorm?
No. Benidorm's beaches are public spaces, and possessing or consuming cannabis on a beach is an administrative offence under Spain's Public Security Law carrying fines of €601 to €30,000. The beach is not a private space under any interpretation of Spanish law. Police patrol Benidorm's seafront and beach areas regularly and do enforce the law against tourists as well as residents.
Is there a cannabis social club in Benidorm I can visit as a tourist?
Cannabis social clubs in Spain are private membership associations that require Spanish residency and pre-registration. Tourists cannot simply visit as walk-in customers. The club network in Benidorm is considerably smaller than in Barcelona or Madrid, reflecting the resort town's predominantly tourist profile. Even if you were to gain membership, the legal status of these clubs remains a grey area subject to varying regional enforcement.
Can I bring my UK medical cannabis prescription to Benidorm?
No. A UK medical cannabis prescription provides no legal protection in Spain. Importing any cannabis product into Spain is a criminal offence regardless of medical status. Spain has its own restricted medical cannabis framework that covers only specific pharmaceutical products on Spanish prescription. UK medical cannabis patients who travel to Spain risk prosecution if found with their medication at the border or by Spanish police.
