Are Vapes Being Banned?
Vaping is not being banned in the UK. Single-use disposables were banned in June 2025 and the Tobacco and Vapes Act 2026 brings new rules around advertising and flavours. Here is exactly what is changing and what stays legal.
No, vapes are not being banned in the UK. What has happened is that single-use disposable vapes became illegal to sell from 1 June 2025. The Tobacco and Vapes Act received Royal Assent on 29 April 2026 and introduces tighter rules on advertising, packaging, flavours and where vaping is permitted outdoors. Refillable and rechargeable vape devices remain fully legal for adults aged 18 and over.
What Has Actually Been Banned?
Only single-use disposable vapes have been banned. From 1 June 2025 it became illegal for any UK retailer to sell, supply or possess for sale a vape that is non-rechargeable or non-refillable. This affects devices like the original Elf Bar 600, Lost Mary and SKE Crystal in their disposable formats. Rechargeable devices with replaceable pods, refillable tank kits and prefilled pod systems with swappable pods are all still completely legal.
The NHS continues to recommend vaping as one of the most effective tools for adult smokers trying to quit cigarettes. Government policy treats adult vaping as a harm-reduction measure while tightening controls on youth access and environmental impact.

The Tobacco and Vapes Act 2026: What It Means for Vapers
The Tobacco and Vapes Act received Royal Assent on 29 April 2026. Its primary aim is to create a smoke-free generation by permanently banning tobacco sales to anyone born on or after 1 January 2009, with the legal purchase age rising by one year every year from 2027. For vapers, the key changes are tighter controls designed to reduce youth uptake rather than restrict adult use.
June 2025

Within 2 months of the Act
A total ban on vape advertising and sponsorship comes into force. Vending machine sales of vapes become illegal.

New Vaping Products Duty of £2.20 per 10ml of e-liquid takes effect, applying to all vaping liquids regardless of nicotine content. E-liquid prices are expected to rise.
January 2027 onwards
The minimum tobacco purchasing age rises by one year annually, meaning anyone born on or after 1 January 2009 will never legally be able to buy tobacco products.
Will Vape Flavours Be Banned?
Not outright, and not yet. The Tobacco and Vapes Act 2026 gives the government new powers to restrict vape flavours and packaging through secondary legislation. The aim is to remove options that are seen as particularly appealing to children, such as sweet and confectionery-style flavours. However, these restrictions are subject to further public consultation and have not yet been finalised. Adult vapers will still be able to access a wide range of flavours for the foreseeable future.
