Can You Vape at 16?

No. The legal age to buy or use vaping products in the UK is 18. It has been since 2015. Here is what the law says, who it applies to and why the age limit exists.

No, you cannot legally vape at 16 in the UK. The minimum age for purchasing any vaping product, including devices, e-liquids, prefilled pods and nicotine-free vapes, is 18. This law came into force on 1 October 2015 under the Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations. It applies to every retailer in England, Scotland, Wales and Northern Ireland, both in-store and online. There is no exception based on whether the product contains nicotine or not.

What the Law Actually Says

The Nicotine Inhaling Products (Age of Sale and Proxy Purchasing) Regulations 2015 made it illegal for any retailer to sell e-cigarettes or e-liquids to anyone under the age of 18. This applies to all vaping products regardless of nicotine content, and it applies equally in physical shops and online. The law aligns the vaping age with the tobacco purchase age, which was raised from 16 to 18 in October 2007.

The legislation covers every type of vaping product on the market. There is a common misconception that nicotine-free vapes might be exempt from the age restriction because they do not contain a controlled substance. This is incorrect. Nicotine-free e-liquids and devices are subject to exactly the same age of sale requirement as nicotine-containing products.

Buying vapes under 18

Illegal. No retailer can sell any vaping product to a person under 18. This applies in shops, at market stalls and online. Reputable retailers use Challenge 25 policies, meaning anyone who appears under 25 must show valid ID.

Proxy purchasing

Illegal. It is a criminal offence for an adult to purchase vaping products on behalf of someone under 18. This is known as proxy purchasing and carries the same penalties as selling directly to a minor.

Possession by a minor

Currently not a direct criminal offence for the young person themselves under the age of sale regulations, though local authorities and schools have powers to confiscate products and issue disciplinary action.

Nicotine-free products

Subject to the same age restriction as nicotine-containing products. The exemption based on nicotine content that some people assume exists does not apply in UK law.

Retailers selling to under 18s

Adults buying for under 18s

Proxy purchasing carries the same penalty as selling directly to a minor: a fine of up to £2,500. The law closes the loophole where minors might ask older friends or siblings to purchase products on their behalf.

While possession is not itself a criminal offence under the age of sale regulations, local authorities can issue Fixed Penalty Notices in some circumstances. Schools apply their own disciplinary policies. Enforcement is increasing following the youth vaping measures in the Tobacco and Vapes Bill 2026.

Why Is the Vaping Age Set at 18?

The age restriction exists because of the documented risks that nicotine poses to the developing brain and body. The adolescent brain is still actively developing until approximately the mid-twenties, and nicotine interferes with the development of the prefrontal cortex, which governs attention, impulse control and decision-making. Nicotine exposure during adolescence significantly increases the risk of addiction compared to adult initiation, as the developing brain forms stronger and more persistent dependencies.

Beyond nicotine specifically, the aerosol from e-cigarettes contains chemicals that are not risk-free, and long-term effects of vaping during adolescence are not yet fully established. The precautionary principle of aligning the vaping age with the tobacco age reflects the government's position that these products are designed for adult smokers looking for a less harmful alternative, not as a starting point for young non-smokers.

Recent Changes to UK Vaping Regulation

The UK regulatory landscape around youth vaping has tightened significantly since 2024. The single-use disposable vape ban, which came into force in June 2025, was partly driven by evidence that flavoured disposable vapes were being heavily marketed to young people. Prior to the ban, youth vaping prevalence reached 20.5% among 11 to 17 year olds, a figure that alarmed health authorities.

The Tobacco and Vapes Bill, which cleared the House of Lords in March 2026, introduced the first formal age limit specifically targeting nicotine pouches and strengthened enforcement powers for Trading Standards with an additional £30 million per year. The bill also makes it illegal to sell tobacco to anyone born on or after 1 January 2009, creating a generational tobacco ban, though this does not currently extend to vaping products.
